THE CUSTOMER ACKNOWLEDGES HAVING READ AND ACCEPTED THESE GENERAL TERMS AND CONDITIONS OF SALE WITHOUT RESERVATION BEFORE ANY PURCHASE ON THE WEBSITE WWW.DARKANDDAZZLING.FR.

These General Terms and Conditions of Sale define the rights and obligations applicable to any order placed with Dark & Dazzling, a sole proprietorship registered under SIRET number 944 789 924 00015, with its registered office located at 94 rue des Rabats, 92160 Antony, France.

ARTICLE 1 – PRODUCTS

The products offered for sale are bags, the essential characteristics of which are described precisely on the website www.darkanddazzling.fr.

ARTICLE 2 – PRICES

Prices are indicated in euros, all taxes included (TTC), excluding delivery costs.

Dark & Dazzling reserves the right to modify its prices at any time. Products are invoiced based on the rates in effect at the time of the order.

ARTICLE 3 – ORDER

Any online validated order implies full and unreserved acceptance of these General Terms and Conditions of Sale.

The order is confirmed only after receipt of full payment. A confirmation email is sent to the Buyer.

ARTICLE 4 – PAYMENT

Payments are secured and accepted via the following solutions: bank cards and other methods offered by Shopify Payments.

Dark & Dazzling does not store any bank details.

ARTICLE 5 – DELIVERY

• Delivery area: France (other areas upon request).
  
• Estimated delivery times: 2 to 7 working days after dispatch (France and European Union); 7 to 20 working days (other areas)
  
• Delivery costs: calculated at the time of order.
  
  In case of a delivery delay exceeding 30 working days, the Buyer may cancel their order and obtain a refund.
  

ARTICLE 6 – TAXATION / VAT / CUSTOMS

Applicable taxation and taxes:

The prices displayed on our website are indicated all taxes included (TTC) for orders shipped to France and the European Union. For deliveries outside the European Union, customs duties, local taxes, import duties, or state taxes may be required upon arrival of the package.

These additional costs are the responsibility of the buyer. They are not included in the price paid at the time of the order. We have no control over these costs and cannot predict their amount. We recommend that you contact your local authorities for more information before placing any order.

ARTICLE 7 – RIGHT OF WITHDRAWAL AND RETURNS

In accordance with Articles L221-18 and following of the Consumer Code, the Buyer has 14 days after receipt of the product to exercise their right of withdrawal, without justification.

Return conditions:

• new, unworn, unwashed, in their original packaging and with all their tags and/or accessories still attached, intact and in good condition.
  
• personalized items cannot be returned.
• must show no signs of wear, makeup, or deterioration.

Any item not meeting these conditions will be refused. This ensures that the item can be offered to another customer in the same impeccable condition as when the first buyer received it.

To guarantee a reassuring, fair, and transparent experience for everyone, a video is made before sending each order and upon receipt of each return.

Return costs are entirely borne by the Buyer (return shipping costs and any customs fees), except in case of error or defect on the part of Dark & Dazzling.

Returns must be sent to the following address: 94 rue des rabats, 92160 Antony, France. No returns will be accepted at a relay point or at any other address.

The refund will be made within a maximum of 14 days after validation of the return.

Parcels not collected at relay points:

If the customer chooses delivery to a relay point and does not collect their parcel within the deadline set by the carrier, it will be automatically returned to us.

In this case, the order will be considered refused by the customer.

The refund will be made upon receipt of the parcel, up to the amount of the order minus the return costs charged by the carrier.

A new shipment may be offered, subject to prior payment of re-shipping fees by the customer and the balance remaining after deduction of return fees.

ARTICLE 8 – LEGAL GUARANTEES

Products benefit from the legal guarantees of conformity (Articles L217-4 to L217-14 of the Consumer Code) and the guarantee against hidden defects (Articles 1641 and following of the Civil Code).

ARTICLE 9 – INTELLECTUAL PROPERTY

All content (texts, images, logo, etc.) present on the website www.darkanddazzling.fr is protected by intellectual property rights.

Any reproduction or use without authorization is strictly prohibited.

ARTICLE 10 – APPLICABLE LAW AND DISPUTES

These General Terms and Conditions of Sale are subject to French law.

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, our company has established a consumer mediation mechanism. The designated consumer mediation entity is: MÉDIATION CONSOMMATION DÉVELOPPEMENT.
